Parking & Bus Lane Fines

There are a number of different ways you can pay your penalty charge notice (PCN), sometimes called a parking fine or ticket.

Bailiff Reform - Important Information if you have an unpaid parking fine

From the 6th April 2014 all Bailiff Action and the fees that can be charged, are be governed by the Tribunals Courts & Enforcement Act 2007 and are made transparent in this document.

Also under this new legislation the word ‘Bailiff’ is now replaced with ‘Enforcement Agent’ (EA)

The new legislation also means that there has been a significant increase in the Enforcement Agents charges for parking fines and would urge you to pay the fine before it is necessary for us to instruct the EA to recover the debt.  Immediately the EA receives that instruction, and before any work has started, the outstanding debt automatically increases by £75.

Under this new legislation there are three stages in the EA recovery schedule and the fees are fixed and set by Government:

  • Stage 1 - Compliance Stage Fee: £75
    This fee is due as soon as the case is received by the Enforcement Agent
    and covers all activity up to commencement of the Enforcement Stage.

  • Stage 2 - Enforcement Stage Fee: £235
    (plus 7.5% of the value of the original debt which exceeds £1500)
    The fee becomes payable as soon as a case has escalated to this stage and comprises all activity from the first attendance at the premises in relation to the instruction.

  • Stage 3 - Sale Stage Fee: £110
    (plus 7.5% of the value of the original debt which exceeds £1500)
    The fee becomes payable as soon as a case has escalated to this stage and comprises all activity to be undertaken.

Please note: You have 14 days to pay your Penalty Charge Notice (PCN) with 50% discount, or you have 28 days to pay your PCN in full.

If you pay your Penalty Charge in full, you will lose your right to appeal.

Please ensure to include your Penalty Charge Notice reference number and Vehicle Register Number in your letter.

Appeals Process

Informal Appeal

Once an initial appeal is received within 14 days of the Penalty Charge issue date, the Penalty Charge is held at the reduced rate whilst the appeal is being considered. Please note we are only able to accept appeals in writing.

We aim to respond to appeals with a written decision within 10 working days.

If we do not agree with your appeal, you will have a further 14 days from the date your decision letter is issued to pay the Penalty Charge at the reduced rate.

If we agree with your appeal, the Penalty Charge with be cancelled and no payment will be required.

Notice to Owner and Formal Appeals

If your Penalty Charge Notice is not cancelled and no payment is received within 28 days, a Notice to Owner will be sent to the registered vehicle owner who must either pay the full charge or make a formal appeal.

We aim to respond to formal appeals within 5 working days.

If the response to your formal appeal is a Notice of Rejection, and you do not agree with our decision, you will need to appeal to the Traffic Penalty Tribunal (TPT) within 28 days.

If you do not wish to continue with your appeal, payment should be made within 28 days of the date the Notice of Rejection was issued.

Please note you must either pay the Penalty or appeal to the Traffic Penalty Tribunal (TPT) within 28 days.

Traffic Penalty Tribunal (TPT)

The Traffic Penalty Tribunal is an independent tribunal whose decision is final.

There is no charge for appeal submissions, although in exceptional cases costs may be awarded against either Tunbridge Wells Borough Council or the Appellant if either's submission is considered to be wholly unreasonable.

Charge Certificate

If the Penalty has not been cancelled or paid within the above timescales, a Charge Certificate is sent which increases the charge by 50%.

Please note there is no right of appeal at this stage and payment must be made within 14 days.

If not then the charge is registered as an outstanding debt at the Traffic Enforcement Centre, which adds a further £7.00.

Order for Recovery and Witness Statements

Any amounts still outstanding are then requested by an Order for Recovery.

This gives 21 days to either make a payment or to file a Witness Statement with the Traffic Enforcement Centre, on one of the limited grounds stated on the Order for Recovery.

Enforcement Agent

If neither payment nor a Witness Statement is made, then a warrant will be issued for the outstanding charge to be recovered by a firm of Enforcement Agents (Bailiffs).

At this stage the Council will not deal with and queries regarding the debt, which must be made directly with the Enforcement Agents.

Alternatively, advice may be sought from the Citizens Advice Bureau.
